The Hart Beat newspaper is generally circulated in San Antonio, Bexar County, Texas in accordance with Tex. Gov't. Code Ann. § 2051.044 (a) (Vernon Supp. 2005).

A "newspaper" is a publication that:

• 1) devote[s] not less than 25% of its total column lineage to general interest items: The Hart Beat complies with this requirement, currently running approximately 85% general interest copy.
• 2) [is] published at least once each week: The Hart Beat complies with this requirement being published three times each week on Monday, Wednesday and Friday.
• 3) [is] entered as second-class [Periodicals] postage matter in the county where published: The Hart Beat complies with this requirement with periodicals postal permit USPS 577-740 mailed out of the San Antonio, Texas Postal Center.
• 4) [has] been published regularly and continuously for at least 12 months before the governmental entity or representative publishes notice: The Hart Beat complies with this requirement as it has been in regular and continuous publication since 1962.
